Terms and conditions

Booking and down payment:

With this booking confirmation the posting is legally binding. Inhabitants of the EU please transfer the down payment within 7 days after you received the booking confirmation or else we are entitled to rent out the flat otherwise.

TUE payment of the rent is due by one week before arrival at the latest by transfer. If the rent is not payed completely by the day of arrival, it will be rated as cancellation. The renter is not released from the payment of the rent, in that he is inhibited in exercising of his petty patent through a reason which is explained in his person.

TUE final cleaning happens independently from the length of the stay. For that we assume a cleaning duration of 2 -3 hours. As mostly the next guests arrive on the same day, we have to stick to this period, which works out almost every time. If this peroids are exceeded because of idle time or extraordinary effort, we will charge seperately 15 € for each commenced hour and per man power.   

Liability:

The renter and his companions are liable as joint and several debtors in its entirety for the caused damage to the inventory of the holiday flat and holiday home. Possible damage has to be reported to us (0049 (0)341/3196200) immediately and can be normally adjusted with your liability insurance. Parents are liable for their children within the limits of statutory regulations. We assume no liability for larceny, fire or water damage to the property of the renter.  

Services and prices:

The scope of the contractual services arise from the booking confirmation. The rental property may only be inhabited by the number of persons, which are stated in the booking confirmation. Children, Babies and pets are rated for that each as one person. The renter is without written permission by us not entitled to leave the rental property and items to a third party for use. Especially to relet it. 

Right to withdraw:

(1) Der Mieter hat das Recht, vom Vertrag zurückzutreten. Dies bedarf der Schriftform. Macht er von diesem Recht Gebrauch, verpflichtet er sich an den Vermieter ein einmaliges  Entgelt in Höhe von 25 € zu zahlen.

(2)Furthermore the renter commits in case of withdrawal as from 30 days before the commencement of the hire to pay the owner 50 % of the total amount. In case of withdrawal as from 14 days before commencement of the hire the renter commits to pay the owner 90 % of the total amount. After we received the withdrawal, we will try to find other guests for the relevant time period immediately.

(3)The renter is free to prove, that there occured a smaller deficit, than mentioned in the lump sums above.

(4)In case the renter booked the additional service „no cancellation fee“, we will not charge a compensation, differently from the provision in passage (2), as long as the renter can prove, that he or one of the stated fellow travelers could not start on the journey due to:
a) Unemployment through no fault of one’s own (Certificate of employment agency)
b) Desease (medical certificate of a licensed doctor about missing ablity to travel)
c) Death (MCCD) 

No-shows and early departure::

If you not arrive or depart early, there will be no claim for refund of the rent.

Reduction of price:

If there occurs a short-term blackout of fixtures, public supply or by force majeure there will be no claim of price-reduction, as long as the blackout was not caused by us or our administrator purposely or wantonly.

Tenant´s rights

If there establish defects during moving into the apartment, please let us and the person who is commissioned by us respectively know about it and write it down.

If your stay is considerably impaired due to a defect or is the apartment uninhabitable and we do not remedy the deficiencies within a reasonable period of time, the renter is entitled to reduce the rent or to cancel. About this the renter has to inform us promptly as complaints can not be accepted later.

The paid rent for the remaining period of the tenancy will be recompensed in this case. We will try to find an equivalent substitute accommodation or we will pay back the rent. Further requirements are excluded except in case of intent or gross on our part or a person who is commissioned by us. 

Facility treatment:

The renter and all fellow travelers commit to treat the apartment and the rooms and fixtures, which are intended for joint use with care. 

House rules:

With moving into the apartment the renter and all fellow travelers commit to take note of the house rules and to respect it. This especially applies for rest periods and the ban on smoking. 

Termination:

In case of multiple non-compliance with the terms of hire the owner can terminate the tenancy agreement unilateral and the guest has to leave the apartment immediately. In this case there will be no claim of recompense.

Parking lot:

Free parking lots are available on the street in front of the house. We do not assume liability for damage, burglary or larceny of the cars.

Features of the apartment:

The number of rooms and the location of the apartment in the building arise from the booking confirmation. You can find an inventory list in every apartment, which shows the current equipment. With moving into the holiday flat, the renter confirms the complete taking over of the inventory.

Severability caluse:

If one of the before described terms of hire is not capable, it will be replaced by the provisions, which are analogous coming as close as possible. The other terms of hire remain unaffected and are still valid.
